Website ("PAW"), and the Center for Civic Education ("CCE"). Your continued use of PAW
constitutes Your acceptance, without limitation, of the terms and conditions of these Terms of
Use. If You do not agree to be bound by these terms, You may not access or use PAW. PAW may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material CCE judges to be threatening or obscene, or material protected by trade secret and other statute. Any user of PAW agrees to indemnify, defend and hold harmless CCE, its affiliates, and their respective officers, directors, employees, agents, successors, assigns, licensors, partners, joint venturers, customers and any other person or entity involved in the creation, production and/or distribution of PAW, from and against any and all claims, liabilities, costs and expenses (including, without limitation, attorneys' fees and expenses) incurred in connection with or arising from any breach by You of these Terms of Use or resulting in connection with or arising from Your use of the PAW site. Users of PAW may only use information on PAW for the purposes of furthering the CCE's civic education programs. CCE takes a zero tolerance approach to the sending of Unsolicited Commercial E- mail (UCE) or SPAM to members of the PAW network, or to others not using the PAW network based on information obtained from the PAW network. Very simply, this means that users of PAW may not use or permit others to use information on PAW to transact in UCE of any kind whatsoever. Users of PAW are also strictly prohibited from using or permitting others to use UCE or SPAM over PAW. Users of PAW also may not republish or distribute information on PAW without the express written consent of CCE; may not take any action that would impede or interfere with the operation of PAW or alter the contents of PAW in any way. Violation of this policy will result in severe penalties. Upon notification of an alleged violation of this policy, CCE will initiate an immediate investigation. During the investigation, CCE may restrict customer access to the network to prevent further violations. If a customer is found to be in violation of this policy, CCE may, at its sole discretion, restrict, suspend or terminate customer's account. Further, CCE reserves the right to pursue civil remedies for any costs associated with the investigation of a substantiated policy violation. CCE will notify law enforcement officials if the violation is believed to be a criminal offense. Due to, among other things, the possibility of human and/or mechanical error, CCE shall not be responsible for any errors or omissions on PAW. CCE makes no representations as to the accuracy or integrity of the information contained on PAW. CCE shall not be liable for any damages of any kind incurred as a result of the information posted on PAW including, without limitation, any content thereon. CCE MAKES NO WARRANTY THAT PAW IS BUG FREE OR ERROR FREE, THAT SAME WILL OPERATE WITHOUT ANY INTERRUPTION, OR THAT USE OF SAME WILL RESULT IN ANY PARTICULAR RESULTS. THERE ARE NO WARRANTIES AGAINST INTERFERENCE WITH YOUR ENJOYMENT OF ANY INFORMATION OR AGAINST INFRINGEMENT. PAW IS PROVIDED "AS IS" AND "WITH ALL FAULTS." CCE HAS MADE AND MAKES NO OTHER WARRANTIES, AND IT DISCLAIMS ALL WARRANTIES EXPRESS OR IMPLIED, OR ARISING BY COURSE OF PERFORMANCE, COURSE OF DEALING OR USAGE OF TRADE, INCLUDING WITHOUT LIMITATION ANY REPRESENTATIONS OR WARRANTIES RELATING TO NONINFRINGEMENT, NONINTERFERENCE, ACCURACY, MERCHANTABILITY, TIMELINESS, PERFORMANCE, TITLE, QUIET ENJOYMENT, FITNESS FOR A PARTICULAR PURPOSE OR THAT ANY INFORMATION, EFFORTS, SERVICES OR SYSTEM PROVIDED BY CCE WILL FULFILL ANY OF YOUR PARTICULAR PURPOSES OR NEEDS. LIMITATIONS ON LIABILITY; INDEMNITY IN NO EVENT SHALL CCE (INCLUDING ITS OFFICERS, DIRECTORS, EMPLOYEES, SUCCESSORS AND ASSIGNS) HAVE LIABILITY FOR PUNITIVE, EXEMPLARY, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OR LOSS (INCLUDING WITHOUT LIMITATION DAMAGES FOR LOST BUSINESS, LOST PROFITS, OR LOST DATA) ARISING IN CONNECTION WITH THESE TERMS OF USE, THE PAW SITE, ANY CONTENT THEREON OR THE USE OR INABILITY TO USE THE PAW SITE, REGARDLESS OF THE LEGAL THEORY ON WHICH SUCH DAMAGES ARE CLAIMED OR REGARDLESS OF WHETHER CCE HAS BEEN NOTIFIED OF THE POSSIBILITY OF SUCH DAMAGES OR LOSS. NOT ALL STATE LAWS ALLOW SUCH LIMITATIONS, AND YOUR RIGHTS MAY VARY. |
